Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Micare desktop application and the website at getmicare.com (collectively, the "Service"), provided by SMST Lifestyle Solutions ("we", "us", "our"), Malaysia.

By downloading, installing, or using Micare, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, please do not use the Service.

1 Nature of the Service — personal project

Please read this section carefully. Micare is an independently developed personal software project, created and maintained by a solo developer. It is offered in good faith as a useful tool, but it is not a product of an enterprise software company and should not be treated as one.

By choosing to use Micare, you acknowledge this context and accept that your use of the Service is entirely at your own discretion and responsibility. We genuinely want the app to serve you well — and we've built it with care — but we ask that you approach it with the reasonable expectations of a thoughtful person using independently developed software.

Nothing in these Terms is intended to be unfair or to catch you off guard. We simply want to be transparent about what Micare is, so that you can make an informed choice about using it.

2 Eligibility

You must be at least 13 years of age to use the Service. By using Micare, you represent that you meet this requirement. If you are between 13 and 18 years of age, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You must have the legal authority to enter into a binding agreement in your jurisdiction.

3 Licence to use the app

Subject to these Terms and payment of any applicable licence fee, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Micare on devices you own or control, for your personal, non-commercial use.

This licence is for your use only and does not transfer ownership of the app to you. All intellectual property rights in Micare remain with SMST Lifestyle Solutions.

4 Free trial

Micare includes a 40-day free trial beginning from the date of first launch. During this period you may use the full functionality of the app at no cost.

At the end of the trial period, access to the app's features will be suspended until a valid licence is purchased. We will send reminder notifications at days 7, 14, 21, 28, 35, and 40 of your trial.

You may not circumvent or manipulate the trial system, including by altering trial-related data in your settings file, creating multiple accounts, or reinstalling the app to obtain additional trial periods. We reserve the right to terminate your access if such behaviour is detected.

5 Payment and licence

Purchasing a Micare licence grants you a perpetual right to use the version of the app available at the time of purchase, subject to these Terms. Future major version upgrades may require a separate purchase; this will be communicated clearly in advance.

All purchases are processed by our payment provider. By purchasing, you also agree to their terms of service. Prices are displayed at the time of purchase and are inclusive of any applicable taxes where required by law.

Refund policy: As Micare is downloadable software with a full 40-day free trial, all sales are generally final. If you experience a technical defect that we cannot resolve within a reasonable time, we will consider refund requests made within 14 days of purchase on a case-by-case basis. 6 Google Calendar integration

Connecting Google Calendar is optional. If you choose to do so, you are also subject to Google's Terms of Service. You are responsible for ensuring your use of the integration complies with your own obligations to Google.

We access your Google Calendar data solely to display upcoming events within the Micare app. We do not store, transmit, or use this data for any other purpose. You may revoke access at any time from within Settings or directly from your Google Account permissions page.

7 Disclaimer of warranties

The Service is provided "as is" and "as available", without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

As an independently developed personal project, Micare is maintained on a best-efforts basis. Features may change, be removed, or become temporarily unavailable. We will always try to communicate significant changes in advance.

8 Limitation of liability

To the fullest extent permitted by applicable law, SMST Lifestyle Solutions shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of data, loss of profits, loss of business, loss of goodwill, or any other intangible loss — arising from or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us for a licence in the twelve months preceding the claim, or RM 50 (Malaysian Ringgit fifty), whichever is greater.

Some jurisdictions do not permit certain limitations of liability. In such cases, our liability shall be limited to the maximum extent permitted by applicable law. Nothing in these Terms limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence.

9 Your responsibility

You are solely responsible for:

We encourage you to maintain backups of any important data independently of Micare. The Service is a display tool and does not store or back up your personal data.

10 Intellectual property

Micare, including its design, code, name, logo, and all associated materials, is the intellectual property of SMST Lifestyle Solutions. All rights not expressly granted in these Terms are reserved.

You may not use our name, logo, or branding in any way that implies endorsement, affiliation, or partnership without our prior written consent.

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without obligation to you.

11 Termination

You may stop using the Service at any time by uninstalling the app. Uninstalling removes the app and local data from your device.

We reserve the right to suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. We will endeavour to give reasonable notice where possible. If your access is terminated for a breach of these Terms, no refund of licence fees will be provided.

Sections covering intellectual property, limitation of liability, disclaimers, and governing law shall survive termination.

12 Changes to the Service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes where practical, particularly those that affect paid features.

We may update these Terms from time to time. Material changes will be indicated by an updated "Last updated" date. Your continued use of the Service after updated Terms are posted constitutes acceptance of those Terms. If you do not agree with updated Terms, your remedy is to stop using the Service.

13 Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. You agree that any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Before initiating formal legal proceedings, we encourage you to contact us at getmicare@getmicare.com to resolve any dispute informally. We will make a genuine effort to address any concern raised in good faith.

If you are a consumer in a jurisdiction with mandatory local consumer protection laws, nothing in these Terms affects your statutory rights under those laws.
